TERMS AND CONDITIONS OF USE

These General Terms and Conditions may be updated or modified at any time by DECARIASHOP SRL, which will notify customers through the appropriate communication channels. The customer undertakes to print and keep a copy of these Terms and Conditions whenever changes are made.

1. SUBJECT OF THE ONLINE CONTRACT AND DEFINITION

An “online sales contract” means a distance contract concerning movable goods and/or services concluded between DECARIASHOP SRL, with registered office in GIOIA TAURO (RC) – Via F. Cilea, 85 – 89013, Italy, and a consumer and/or customer within a distance selling system organized by the supplier, using exclusively internet communication technology.

All contracts are concluded directly through access by the customer to the website www.decarishop.it, following the indicated procedures.

DECARIASHOP SRL may request discretionary confirmation of the order.

A “consumer” is any natural person acting for purposes outside their trade, business or profession. Contracts are governed by Italian Legislative Decree 206/2005 (Consumer Code).

2. SALES PRICES AND PURCHASE METHODS

All prices displayed on the website include VAT.

Shipping costs are borne by the customer and clearly indicated before order confirmation. For international shipments, customers may request additional information by writing to info@decariashop.it.

The purchase contract is finalized upon correct completion of the online order form.

Accepted payment methods:

  • Cash on delivery (additional €3 fee)

  • Advance bank transfer payable to DECARIASHOP SRL

  • Credit cards (Visa, Mastercard, CartaSì, American Express)

  • Postal payment payable to DECARIASHOP SRL

3. PRODUCT AVAILABILITY

The website system indicates product availability in real time. In case of unavailability after order placement, the customer will be informed.

If delivery cannot be completed within the legal timeframe under Article 54 of Legislative Decree 206/2005, the contract shall be terminated and DECARIASHOP SRL will refund the payment.

4. EXECUTION OF THE CONTRACT AND DELIVERY

DECARIASHOP SRL will ship products via trusted couriers.

Delivery is deemed completed upon the first delivery attempt by the courier.

In cases where delivery failure is not attributable to DECARIASHOP SRL, shipping costs may be retained.

5. CUSTOMER OBLIGATIONS

Customers must provide truthful and accurate information.

It is strictly prohibited to provide false data or third-party data.
DECARIASHOP SRL may request a copy of a valid identity document.

The customer releases DECARIASHOP SRL from liability for tax documents issued incorrectly due to inaccurate data provided by the customer.

6. PAYMENTS

By completing the payment process, the customer authorizes DECARIASHOP SRL to charge the total purchase amount using the selected payment method.

Transactions are processed via secure banking connections.

In case of withdrawal, the refund will be made using the same payment method.

7. LIABILITY

Once goods are handed over to the carrier, DECARIASHOP SRL shall not be liable for transport-related damages.

The customer must inspect goods upon delivery and note any damage on the courier’s delivery document.

Claims without written reservation to the courier will not be accepted.

Product images on the website are for illustrative purposes only.

8. WARRANTY

Products are covered by a 24-month legal conformity warranty for consumers under Italian law.

The customer may request repair or replacement.

Return shipping costs are initially borne by the customer.

9. RIGHT OF WITHDRAWAL

Consumers have the right to withdraw from the contract within the time limits established by the Italian Consumer Code.

Withdrawal must be communicated via email to info@decariashop.it.

Returned products must be intact, unused, and complete with original packaging.

Refunds will be issued within the legal timeframe.

10. COMPLAINTS

Complaints must be submitted via the online form or by email to info@decariashop.it.

A response will be provided within 3 working days.

11. CONTRACT TERMINATION

DECARIASHOP SRL reserves the right to terminate the contract in case of customer breach.

12. PERSONAL DATA PROCESSING

Personal data are processed in accordance with applicable laws.

13. JURISDICTION AND COMPETENT COURT

All disputes are subject to Italian jurisdiction.

The Court of Palmi shall have exclusive jurisdiction, except where otherwise provided by consumer protection law.

SCALAPAY PAYMENT

“If you purchase with Scalapay, you will receive your order immediately and pay in 3 installments. You acknowledge that the installments will be assigned to Incremento SPV S.r.l., related entities and their assignees, and you authorize such assignment.”
